Lawful bases and data protection rights

Under UK data protection law, we must have a “lawful basis” for collecting and using your personal information. There is a list of possible lawful bases in the UK GDPR. You can find out more about lawful bases on the ICO’s website.

Which lawful basis we rely on may affect your data protection rights which are set out in brief below. You can find out more about your data protection rights and the exemptions which may apply on the ICO’s website:

If you make a request, we must respond to you without undue delay and in any event within one month.

To make a data protection rights request, please contact us using the contact details at the top of this privacy notice.

Our lawful bases for the collection and use of your data

Our lawful bases for collecting or using personal information for website analytics are:

  • Consent - we have permission from you after we gave you all the relevant information. All of your data protection rights may apply, except the right to object. To be clear, you do have the right to withdraw your consent at any time.

Our lawful bases for collecting or using personal information for dealing with queries, complaints or claims are:

  • Legitimate interests – we’re collecting or using your information because it benefits you, our organisation or someone else, without causing an undue risk of harm to anyone. All of your data protection rights may apply, except the right to portability. Our legitimate interests are:

  • We collect the name and contact details of individuals who submit our website contact form so that we can respond to their enquiry, whether it relates to our services, general questions, or feedback. This processing is necessary and proportionate: we only use the information to reply to the specific query raised, and we only use the contact details the person has chosen to give us for that purpose. People filling in the form would reasonably expect us to use their details to get back to them — this is the normal and intended outcome of using a contact form. The risk to the individual is minimal, as the data is limited to name and contact details, used only to respond to their enquiry, and not for any unrelated marketing or other purpose. We therefore consider our interest in being able to communicate with enquirers is proportionate and does not override their rights.

Our lawful bases for collecting or using personal information for direct marketing to businesses are:

● Legitimate interests – we’re collecting or using your information because it benefits you, our organisation or someone else, without causing an undue risk of harm to anyone. All of your data protection rights may apply, except the right to portability. Our legitimate interests are:

o We contact individuals in HR, people and operations roles at UK businesses to tell them about our people analytics services, which may be relevant to their work. We only use business contact details obtained from business contact data providers or publicly available sources, and we only send unsolicited marketing emails to corporate business addresses. Each message identifies who we are, explains where we got the contact details and gives a simple way to opt out. People in these roles would reasonably expect occasional relevant business approaches, the data is limited to business contact information, and we delete it if there is no response within 6 months. We therefore consider our interest proportionate and that it does not override their rights.

Your right to object to direct marketing:
you can ask us to stop contacting you for marketing at any time by replying to any of our emails or emailing Hello@veritasbiconsultancy.com. We will stop straight away and keep only the minimum details needed to make sure we don’t contact you again.

Our lawful bases for collecting or using personal information for delivering and managing client contracts are:

● Contract – where our client is a sole trader or partnership, we have to collect or use your information so we can enter into or carry out a contract with you. All of your data protection rights may apply, except the right to object.

● Legitimate interests – where our client is an organisation, we use the names and contact details of the individuals we work with there. All of your data protection rights may apply, except the right to portability. Our legitimate interests are:

o We use the business contact details of individuals at our client organisations so that we can deliver the services we have agreed with that organisation, including arranging meetings, sharing deliverables and managing invoices. This processing is necessary for us to perform our contract with the organisation, and individuals in these roles would reasonably expect us to contact them about the work. The data is limited to business contact details and work correspondence, so the risk to the individual is minimal. We therefore consider our interest proportionate and that it does not override their rights.

● Legal obligation – we have to keep invoices, payment records and related correspondence for 6 years to meet UK accounting and tax requirements. All of your data protection rights may apply, except the right to erasure, the right to object and the right to data portability.

We do not make any decisions about you based solely on automated processing, including profiling, that have legal or similarly significant effects on you.

For more information on our use of legitimate interests as a lawful basis you can contact us using the contact details set out above.
